An Osseo, Wis., man has been sentenced to two years in prison and five years extended supervision for setting a 2007 fire that destroyed the Gin Mill Tavern in Bluff Siding, Wis. Buffalo County Circuit Judge James Duvall sentenced 37-year-old David A. Osley after he pleaded guilty Jan. 29 to felony arson. A burglary charge was dropped as part of a plea agreement. Investigators say Osley used an accelerant to ignite a fire on the main floor of the tavern near a smashed window. A co-owner of the business spotted smoke from his residence near the tavern and reported the fire. The tavern was also a strip club and informal headquarters for the Road Dogs Motorcycle Club. It had to be razed because of damages. The Gin Mill fire was "suspicious in nature" and was under investigation since it happened, Buffalo County Sheriff Michael Schmidtknecht said in 2008. Osley was in custody for multiple drunken driving offenses when he became a suspect and was interviewed by investigators. He admitted he was involved in the incident, Schmidtknecht said. Osley said at his sentencing he is an alcoholic, and traced his criminal history to times when he was drunk and out of control. Court records show that Osley had a prior criminal history for auto theft, trespassing and theft of a money strong box from a residence. His rap sheet dates back to 1993. He pledged to avoid drinking and control his addiction and behavior. He wants to become closer to his family and possibly go to school to learn a trade and become more accountable for his life, he said. Although Osley expressed remorse for setting the fire and pledged to reform his life, Judge Duvall said Osley would have a "long ways to go before proving himself." Duvall said arson was a rare and dangerous crime against society and reminded Osley of the danger it poses to firefighters. Buffalo County District Attorney Tom Clark said the insurance settlement for the fire was $113,000. Duvall agreed with attorneys that Osley was unable to pay restitution to the insurance company, and ordered him to pay $500 to Gin Mill Inc., issue a written apology and avoid contact with motorcycle club members and their property. Osley received 257 days credit for time served in jail, and will be eligible for "risk reduction" in sentencing through a new Department of Corrections program, where agents will assess Osley's needs for counseling or other rehabilitation services that could lead to an early discharge. Osley must complete 120 hours of community service work during his first year of release on extended supervision, and must stay sober and out of taverns and bars.
